1. Acceptance of Terms

By downloading, installing, or using HealthSync ("the app"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the app.

2. Description of Service

HealthSync is a mobile application that syncs health and fitness data from Fitbit to Apple Health on your iOS device. The app reads data from the Fitbit API and writes it to Apple HealthKit. All data processing occurs locally on your device.

3. Eligibility

You must be at least 13 years of age to use this app. By using HealthSync, you represent and warrant that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian.

4. Account Requirements

To use HealthSync, you need:

  • An active Fitbit account
  • An iPhone running iOS 16 or later
  • Access to Apple Health on your device

You are responsible for maintaining the security of your Fitbit account credentials. HealthSync is not responsible for any unauthorized access to your Fitbit account.

5. Free and Pro Plans

5.1 Free Plan

The free version of HealthSync provides basic sync functionality including steps and distance data, manual sync, and access to the last 7 days of data.

5.2 Pro Subscription

HealthSync Pro is available as a monthly or annual subscription that unlocks additional features including heart rate sync, sleep data, workout sync, automatic background sync, and full history access.

5.3 Subscription Terms

  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions in your App Store account settings
  • No free trial is offered. Subscriptions begin immediately upon purchase

5.4 Refunds

All purchases are processed through Apple's App Store. Refund requests must be directed to Apple in accordance with their refund policy.

6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the app
  • Attempt to gain unauthorized access to the app's systems or networks
  • Use the app for any unlawful purpose
  • Redistribute, sublicense, or resell the app
  • Use automated means to interact with the app beyond normal usage

7. Health Data Disclaimer

HealthSync is not a medical device. The app simply transfers data between Fitbit and Apple Health. It does not provide medical advice, diagnoses, or treatment recommendations.

  • Data synced may not be 100% identical to what appears in the Fitbit app due to differences in how Fitbit and Apple Health categorize and display data
  • Do not rely on synced data for medical decisions. Always consult a healthcare professional for medical concerns
  • We do not guarantee the accuracy, completeness, or timeliness of any synced data

8. Intellectual Property

All content, features, and functionality of HealthSync (including but not limited to design, code, graphics, and logos) are owned by HealthSync and are protected by copyright, trademark, and other intellectual property laws.

Fitbit is a trademark of Google LLC. Apple, Apple Health, and HealthKit are trademarks of Apple Inc. These trademarks are used for descriptive purposes only and do not imply endorsement.

9. Third-Party Services

HealthSync relies on third-party services (Fitbit API, Apple HealthKit) that are beyond our control. We are not responsible for:

  • Changes to the Fitbit API that may affect app functionality
  • Changes to Apple HealthKit that may affect data writing
  • Outages or downtime of third-party services
  • Changes to Fitbit's or Apple's terms of service or data policies

10. Limitation of Liability

To the maximum extent permitted by applicable law, HealthSync and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or related to your use of the app.

Our total liability for any claim arising from the use of HealthSync shall not exceed the amount you paid for the app in the 12 months preceding the claim.

11. Disclaimer of Warranties

HealthSync is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or that defects will be corrected.

12. Termination

We reserve the right to suspend or terminate your access to the app at any time, with or without cause, with or without notice. Upon termination, your right to use the app will immediately cease.

You may terminate your use at any time by deleting the app and canceling any active subscription through the App Store.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the app after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
